The following Terms of Service outline the legal agreement governing participation in our programs and use of our websites and services. Please read carefully.
IMPORTANT – PLEASE READ CAREFULLY
Continued enrollment and participation in the Academy are expressly conditioned upon parental acceptance of these Terms. If you do not agree to these Terms, you must discontinue enrollment, and your child(ren) may NOT participate.
By clicking “I Agree,” completing enrollment, accessing the platform, or permitting participation in any live or recorded session, you provide legally binding consent on behalf of yourself and your minor child(ren).
1. Overview and Agreement
These Terms of Service (“Terms”) form a legally binding agreement between you and BGM Ventures LLC.
Your use of:
including all membership areas, checkout pages, communications, live sessions, recordings, replays, digital content, in-person activities, merchandise, and related services (collectively, the “Service”) constitutes agreement to these Terms.
2. Parental Consent and Recording Authorization
By enrolling a minor, you represent that you are the parent or legal guardian and have full legal authority to consent.
You provide express, informed, and verifiable parental consent for participation in:
Live online sessions
In-person programming
Group discussions
Athletic or physical activities
Recorded sessions
You acknowledge:
Sessions may be recorded.
Your child’s name, voice, image, likeness, and chat content may appear.
Recordings may be accessible within secure internal platforms.
Recordings are for internal educational and administrative purposes only.
Recordings will not be publicly used for advertising without separate written consent.
The Academy complies with applicable privacy laws, including COPPA.
3. Minor Student Code of Conduct
Participation is a privilege.
3.1 Respectful Behavior
Students must treat others with respect and refrain from harassment, bullying, or disruptive conduct.
3.2 Online Conduct
Students must use appropriate settings, language, and behavior.
3.3 Recording Restrictions
No participant may record, copy, distribute, screenshot, or repost sessions without written permission.
3.4 Safety Standards
Students may not share personal addresses, phone numbers, or sensitive family information.
3.5 Disciplinary Action
BGM may issue warnings, suspend, or terminate enrollment (without refund) for violations.
Parents agree to supervise compliance.
4. Service Overview
We offer merchandise, digital products, memberships, in-person programs, and educational services (collectively, “Products”).
5. Eligibility
Accounts must be created by individuals age 18 or older.
Programs for minors require parental supervision and consent.
6. Accounts and Registration
You are responsible for maintaining account security and activity under your login credentials.
7. Payments and Memberships
All fees are in U.S. Dollars and disclosed at checkout.
Recurring memberships renew automatically until canceled.
Digital products and memberships are non-refundable unless required by law.
8. Live Sessions and Replays
Participation constitutes consent to internal recording and replay access.
If replay visibility is declined, camera-off participation may be required.
9. Educational Purpose; No Professional Advice
All programs are for educational purposes only.
No medical, psychological, financial, or legal services are provided.
No guarantees of outcomes are made.
10. Community Conduct
We may restrict or remove participants for harassment, safety concerns, or violations.
11. Returns and Refunds
Defective physical products may be returned within 30 days.
Digital products are non-refundable unless required by law.
12. Shipping and Delivery
Delivery dates are estimates. Risk transfers to the carrier upon shipment.
13. Intellectual Property
All content is owned by BGM or its licensors and protected by law.
Unauthorized copying, resale, or distribution is prohibited.
14. International Users
Users outside the United States are responsible for compliance with local laws.
15. Prohibited Conduct
You agree not to:
Violate laws
Infringe intellectual property
Disrupt services
Introduce malware
Impersonate others
Collect personal data improperly
Share protected recordings
16. Termination
BGM may suspend or terminate access at its sole discretion.
Provisions intended to survive termination shall survive.
17. Disclaimers; No Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY LAW, BGM DISCLAIMS ALL WARRANTIES.
18. Limitation of Liability; Assumption of Risk; Release; Indemnification
18.1 Assumption of Risk
Participation may involve inherent risks including physical injury, illness, emotional distress, athletic strain, or property damage. You voluntarily assume all such risks.
18.2 Limitation of Liability
To the fullest extent permitted by law, BGM shall not be liable for indirect, incidental, special, consequential, or punitive damages.
Total liability shall not exceed the amount paid in the twelve (12) months preceding the claim.
Nothing limits liability for gross negligence or willful misconduct.
18.3 Release
You release and discharge BGM from claims arising out of participation, except where prohibited by law.
18.4 Indemnification
You agree to indemnify and hold harmless BGM from claims arising from:
Your child’s participation
Violation of these Terms
Misconduct by you or your child
Third-party claims related to your child’s actions
This obligation survives termination.
19. Dispute Resolution; Mediation; Binding Arbitration; Class Action Waiver
These Terms are governed by:

19.1 Agreement to Arbitrate
Any dispute arising from participation, injury claims, payments, dismissal, or these Terms shall be resolved exclusively as follows.
19.2 Mandatory Mediation
Disputes must first be submitted to confidential mediation administered by JAMS in Los Angeles, California.
19.3 Binding Arbitration
If unresolved, disputes shall be resolved by confidential binding arbitration before a single arbitrator through JAMS in Los Angeles, California.
The arbitrator may award relief available under applicable law.
Judgment may be entered in any court of competent jurisdiction.
19.4 Jury Trial Waiver
You waive the right to trial by jury.
19.5 Class Action Waiver
Claims must be brought individually only. No class, collective, representative, or private attorney general actions are permitted.
19.6 Parental Agreement
By enrolling a minor, you agree to this arbitration provision on behalf of yourself and your child.
19.7 Severability
If any portion is unenforceable, the remainder remains in effect.
20. Force Majeure
BGM is not liable for delays caused by events beyond reasonable control.
21. Miscellaneous
21.1 Entire Agreement
These Terms constitute the entire agreement.
21.2 Assignment
Rights may not be assigned without written consent.
21.3 Changes
We may update these Terms. Continued use constitutes acceptance.
21.4 Governing Law
Except as provided in Section 19, venue for permitted court actions lies in Los Angeles County, California.
